What is the process for a temporary worker (H-2A / H-2B) to adjust to permanent status?
Employers who want to sponsor one or more temporary workers for permanent resident status must complete the process for permanent labor certification (PERM) with DOL. The process is similar to, but simpler than, the H-2A / H-2B process. After the labor certification is obtained, the employer and sponsored worker can concurrently file applications with USCIS to adjust the worker's status to permanent, or apply for an immigrant visa at a consulate outside the US.
